Terms and conditions

1. Scope

These terms govern the use of the website medicalsimulation.eu, maintained by SMF Ltd. (hereinafter "SMF"), and the submission of enquiries through it. For deliveries of products and services, the conditions additionally agreed in the respective contract apply; in the event of conflict, the contract prevails.

2. Purpose of the website

The website addresses medical professionals, healthcare facilities, universities and companies in the medical industry. It is not an online shop: the products presented cannot be ordered directly and their presentation does not constitute a binding offer within the meaning of the law.

The content is for informational purposes. It does not constitute medical advice and does not replace the instructions for use, training and recommendations of the manufacturer for the respective device.

3. Enquiries and offers

An enquiry submitted via the form is an invitation to SMF to provide a quotation. A contract is only formed upon written confirmation by SMF.

Offers are prepared individually and are valid for the period stated in them. Price information is not published on the website.

4. Product data

Technical data — number of training cases, modules, dimensions, specifications — are taken from materials of the manufacturers VirtaMed AG and Mentice AB. The scope of delivery is determined by the respective offer. The manufacturer reserves the right to make changes to the design and software that serve technical development and do not impair the intended purpose of the device.

5. Delivery, installation and training

Delivery periods, the scope of installation, commissioning and staff training are agreed individually for each project and are set out in the offer. [standard periods and scope — to be completed]

6. Warranty and support

Warranty conditions follow those of the manufacturer and are set out in the offer. Extended warranty and support contracts are available. [warranty period and scope of support — to be completed]

7. Liability

SMF is liable in accordance with applicable Bulgarian law. Liability for website content is limited to intent and gross negligence, to the extent that life, physical integrity, health or essential contractual obligations are not affected.

SMF is not liable for temporary unavailability of the website due to maintenance, network disruptions or circumstances beyond its control.

8. Content rights

The texts, images and layout are protected. Use beyond what is permitted by law requires written consent. The manufacturers' trademarks remain their property — see the legal notice.

9. Applicable law and jurisdiction

Bulgarian law applies. Where the client is a trader or a public-law entity, disputes are subject to the jurisdiction of the court at SMF's registered seat — Sofia. Mandatory provisions in favour of consumers remain unaffected.

10. Changes

SMF may amend these terms. For contracts already concluded, the version in force at the time of conclusion applies.
